26. mája 2009 ju na tento úrad nominoval prezident Barack Obama. 6. augusta 2009 Senát potvrdil jej nomináciu. Dva dni neskôr ju predseda Najvyššieho súdu USA John Roberts vymenoval do funkcie. Je prvým Hispáncom a treťou ženou na poste.Šesť rokov bola členkou organizácie National Council of La Raza. Wikipedia
